This manual describes the business’s public information, possible record categories and how to request access to records. It must be completed against the business’s actual records and internal procedures; it is not evidence that a requested record exists or that unrestricted access will be granted.

2. The Information Regulator’s PAIA guide
The Information Regulator publishes a guide explaining PAIA, how to request records and available remedies. Access the guide through the Regulator’s PAIA resources, or contact the Regulator through its official website. The current prescribed request and outcome forms are available from the Regulator’s PAIA resources.
3. Information available without a formal request
Published product descriptions, indicative prices, contact details, trading hours, the privacy notice and this manual are available on the website without a formal PAIA request. This does not mean private customer records are publicly available. No separately gazetted voluntary disclosure notice has been verified.
4. Record categories
The following is a working inventory to be confirmed by the business. Records are accessible only if held and subject to PAIA’s requirements and grounds for refusal.
- Customer orders
- WhatsApp messages, names, contact details, delivery addresses, optional map links, order quantities and related enquiries.
- Sales and finance
- Invoices, receipts, payment confirmations, accounting and tax records, where maintained.
- Business administration
- Company registration documents, business correspondence, supplier information and agreements, where held.
- Food-business operations
- Licences or certificates, sourcing, stock, food-handling and delivery records, where held. Their existence or validity has not been verified by this manual.
- Employment and service providers
- Staff or contractor records, if the business employs staff or engages contractors.
- Website and privacy administration
- Website configuration, privacy enquiries and available service or security records, where held. Provider-controlled records may not be held by the business.
5. Records under other legislation
Depending on the business’s activities, records may be required under the Companies Act 71 of 2008, tax legislation including the Tax Administration Act 28 of 2011, the Consumer Protection Act 68 of 2008, POPIA 4 of 2013, the Foodstuffs, Cosmetics and Disinfectants Act 54 of 1972 and its hygiene regulations, the Businesses Act 71 of 1991 and the Meat Safety Act 40 of 2000. Employment laws may apply if staff are employed. The business must confirm which laws and records apply; this list is not exhaustive and does not confirm compliance.
6. How to request a record
- Obtain the prescribed PAIA Form 2 — Request for Access to Record from the Information Regulator.
- Identify the record clearly, your preferred form of access and your contact details. For a private-body request, explain the right you wish to exercise or protect and why the record is required.
- If acting for someone else, provide proof of your authority. Supply only identity information reasonably required to process the request securely.
- Send the completed request to the business email above, marked “PAIA request — MARC-KHAN GOODS”, or deliver it to the listed address for the attention of the head of the business / Information Officer.
For access to your own personal information under POPIA, contact the same email and state that your request concerns your own information.
7. Fees, decisions and remedies
Prescribed request or access fees may apply, subject to applicable exemptions. Access to your own personal information is treated differently from other requests. The business must notify you of any lawful fee or deposit before proceeding; this manual does not introduce its own fees. Consult the Regulator’s fee schedule.
PAIA generally requires a decision within 30 days after receipt of a qualifying request. A permitted extension of up to a further 30 days requires notification and reasons. The decision should explain access arrangements, any fees, or the grounds for refusal, using the prescribed Form 3 — Outcome of request and fees payable. Failure to decide within the statutory period is treated as a deemed refusal.
Access can be limited or refused on statutory grounds, including protection of another person’s privacy, protected commercial information or legally privileged material. Where appropriate, accessible portions can be separated from protected material.
A private body has no PAIA internal appeal procedure. You may use the applicable complaint process with the Information Regulator or apply to a competent court. Remedies have statutory deadlines; consult the Regulator’s current guide promptly. An informal discussion with the business does not suspend those deadlines.
8. Personal information processing
Customer names and contact details support order identification and communication; delivery addresses support fulfilment. Optional coordinates help Google Maps find an address and may be included in an order map link. Data subjects include customers and enquirers; supplier, staff and contractor information may also be processed if applicable.
Recipients can include WhatsApp/Meta, Google Maps, website hosting and connector providers, and delivery personnel where involved. Provider processing may occur outside South Africa. The business must verify recipient arrangements and POPIA cross-border safeguards. Read the privacy notice for the website’s actual data flows and customer choices.
